TRANSFERS

Transfers can occur in different circumstances where a Contract for Sale of Land is not required, such as:-

Transferring a spouse or de facto partner on Title.


Transferring between family members.  E.g. A parent giving their house to a child.


Transferring due to separation of spouse, de facto partner or partner.

 

Transfers generally have the same steps of buying or selling a property without the steps of preparing a Contract for Sale of Land, exchanging that Contract and any cooling off period.

The main benefits to Transferring without a Contract for Sale are:-

Cost effective as there is no cost for preparation of the Contract for Sale.


Can be a faster transaction, dependant on whether any funds are being borrowed and the banks requirements.
 

Stamp Duty exemptions or concessions may apply.

It is important to note that some Transfers will require parties to have separate representation.
